Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AlphaWhisper AI website, waitlist, and platform (together, the "Service"). By joining the waitlist, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is (and is not)

AlphaWhisper AI provides research and decision-support software for informational and educational purposes only. The Service aggregates and analyzes market data and presents signals, scores, maps, and commentary.

No investment advice. Nothing in the Service constitutes investment, financial, legal, tax, or accounting advice, or a recommendation or solicitation to buy or sell any security or derivative. Signals are observations, not instructions.
No fiduciary relationship. Use of the Service does not create an advisor-client or fiduciary relationship of any kind.
You decide. All trading decisions, order placement, sizing, and risk management are solely yours.
No broker services. The Service does not execute trades, hold funds, or connect to your brokerage account.

2. Risk disclosure

Trading options, futures, and other securities involves substantial risk of loss and is not suitable for every investor. You may lose more than your initial investment. Past performance of any signal, model, or track record shown in the Service does not guarantee future results. Market data can be delayed, incomplete, or incorrect. Never trade with money you cannot afford to lose.

3. Eligibility and accounts

You must be at least 18 years old to use the Service.
Account access is personal. Sharing credentials is prohibited, and every login is audited. We may suspend accounts we reasonably believe are shared or compromised.
You are responsible for keeping your credentials secure and for all activity under your account.

4. Acceptable use

You agree not to: (a) scrape, harvest, resell, or redistribute Service data or signals; (b) reverse engineer, decompile, or attempt to extract the Service's models, methodologies, or source code; (c) use the Service to build a competing product; (d) interfere with the Service's operation or attempt to bypass access controls; (e) use the Service for any unlawful purpose, including market manipulation.

5. Intellectual property

The Service, including its software, models, scores, signal methodologies, design, and content, is owned by AlphaWhisper AI and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial trading research while your account is in good standing.

6. Third-party data and services

The Service relies on third-party market-data providers and infrastructure. We do not control and are not responsible for the accuracy, completeness, or availability of third-party data. Outages, delays, and errors upstream can affect the Service.

7. Waitlist and beta features

Joining the waitlist does not guarantee access, pricing, or timing. Features marked as beta or experimental may change or be removed at any time. During early access, the Service is provided with reduced availability commitments.

8. Fees

Current pricing, if any, is presented at signup or upgrade. We may change pricing prospectively with reasonable notice. Fees are non-refundable except where required by law.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SIGNALS WILL BE PROFITABLE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPHAWHISPER AI AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, TRADING LOSSES, OR LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS IF YOU HAVE PAID NOTHING.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, suspected abuse, or discontinuation of the Service. Sections 5, 9, 10, and 12 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the Service or by email. Continued use after changes take effect constitutes acceptance.
